Lucky You provides Shopify merchants with gamified storefront engagement tools, including promotional popups, reward systems, customer email capture, discount generation, and analytics infrastructure.

2. Eligibility

To use Lucky You, you must:

• Be at least 18 years old
• Have authority to act on behalf of your business
• Operate a valid Shopify store
• Comply with applicable laws and Shopify platform requirements
• Provide accurate account information

By using Lucky You, you represent that you meet these requirements.

3. Service Overview

Lucky You offers merchants tools to:

• Launch promotional games (spin-to-win, plinko, wheel, etc.)
• Capture customer emails
• Generate rewards and discount codes
• Track customer interactions
• Manage impression limits
• Access merchant dashboards and analytics
• Configure reward and promotional campaigns

Lucky You may modify, improve, suspend, or discontinue features at any time.

4. Merchant Responsibilities

Merchants are solely responsible for:

• Compliance with local, national, and international laws
• Promotional, sweepstakes, contest, and discount legality
• Customer disclosures
• Consent collection
• Email marketing compliance
• Tax obligations
• Reward legality
• Discount accuracy
• Storefront content
• Customer support related to merchant promotions

Lucky You does not provide legal advice.

Merchants are solely responsible for ensuring their campaigns, promotions, discounts, rewards, and storefront practices comply with all applicable laws and regulations.

5. Billing and Subscription Terms

Lucky You may offer:

• Monthly subscription plans
• Usage-based pricing
• Impression-based billing
• Capacity add-ons
• Premium upgrades
• Feature-based limitations

Payment terms

• Billing is processed through Shopify billing systems
• Fees are due according to selected plans
• Subscription charges are generally non-refundable

Exception

Refunds may be issued in cases of:

• Accidental duplicate billing
• System malfunction
• Platform billing error
• Unfair technical malfunction directly caused by Lucky You

Refund determinations remain at Lucky You’s sole discretion unless otherwise required by law.

Pricing changes

Lucky You reserves the right to:

• Change pricing
• Modify plans
• Introduce new fees
• Adjust usage limits
• Alter features

Reasonable notice will be provided where practical.

6. Acceptable Use

You may not use Lucky You to:

• Violate laws
• Mislead customers
• Conduct fraudulent promotions
• Abuse discounts
• Circumvent billing
• Exploit platform vulnerabilities
• Distribute spam
• Harvest data unlawfully
• Damage Shopify infrastructure
• Interfere with service reliability

Abuse prevention

Lucky You reserves the right to suspend, restrict, or terminate merchants engaging in:

• Fraud
• Abuse
• Excessive exploitation
• Platform misuse
• Security threats
• Policy violations

7. Data Usage and Privacy

Use of Lucky You is also governed by the Privacy Policy.

Lucky You processes merchant and customer data as necessary to provide services.

Merchants are responsible for lawful customer data collection and usage.

8. Intellectual Property

All Lucky You software, branding, systems, interfaces, and infrastructure remain the exclusive property of Lucky You.

Merchants retain ownership of

• Their store content
• Customer relationships
• Merchant-provided assets
• Uploaded creative materials

Restrictions

You may not:

• Reverse engineer
• Resell unauthorized versions
• Clone the platform
• Remove branding unlawfully
• Copy proprietary infrastructure

9. Service Availability

Lucky You strives for reliability but does not guarantee:

• Continuous uptime
• Error-free operation
• Uninterrupted service
• Specific conversion outcomes
• Sales increases
• Compatibility with all themes or systems

Lucky You is not liable for

• Downtime
• Shopify outages
• Third-party failures
• Lost sales
• Missed leads
• Promotion errors caused by merchant misconfiguration

10. Limitation of Liability

To the maximum extent permitted by law, Lucky You shall not be liable for:

• Indirect damages
• Lost profits
• Lost revenue
• Data loss
• Customer disputes
• Promotional legal violations
• Merchant misuse
• Shopify platform disruptions
• Third-party outages

Maximum liability

Lucky You’s total liability shall not exceed the fees paid by the merchant in the prior 3 months.

11. Indemnification

You agree to indemnify and hold Lucky You harmless from claims arising from:

• Merchant promotions
• Sweepstakes legality
• Customer disputes
• Marketing violations
• Regulatory penalties
• Merchant misuse
• Discount abuse
• Content violations

12. Termination

Lucky You may suspend or terminate service for:

• Non-payment
• Fraud
• Abuse
• Legal violations
• Security threats
• Shopify policy violations
• Platform misuse

Upon termination

• Access may be revoked
• Features may cease
• Customer-facing widgets may stop functioning
• Data retention may follow Privacy Policy provisions

13. Shopify Platform Dependency

Lucky You depends on Shopify infrastructure.

We are not responsible for:

• Shopify API limitations
• Shopify billing interruptions
• Shopify outages
• Theme compatibility changes
• Shopify policy updates

14. Modifications to Terms

Lucky You may update these Terms periodically.

Continued use after updates constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of:

Slovenia / European Union

Any disputes shall be handled under applicable Slovenian or EU legal frameworks unless otherwise required by law.

16. Dispute Resolution

Parties agree to attempt good-faith resolution prior to formal legal proceedings where practical.

17. Force Majeure

Lucky You is not liable for failures caused by events beyond reasonable control, including:

• Infrastructure outages
• Cyberattacks
• Natural disasters
• Regulatory actions
• Third-party provider failures

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the full agreement between Lucky You and the merchant.
